Annual review questions

I have a few questions about the timing of an AR.

We had our first one this year in March. It should have taken place before January as the statement was issued in Jan a year ago. We have appealed against this AR with a date in Feb 2013 for a hearing.

Should the next AR now be held 12 months from the Jan date or 12 months from the last AR in March? I assume the appeal won't affect it?

Also, another factor is a Y5 transition review will have to be held in the summer. Is this in addition to the AR?

I think that it's supposed to be 12 months from the date the statement was originally issued. Ours has always fluctuated by a month either side over the last ten years.

It's the date from which the statement was finalised post Tribunal. So if Tribunal is held in Jan and then you recieve the amended final statement on the 15th Feb - 15th Feb is your cut off date for AR.

I only know this cos I checked with my solicitor, + IPSEA both of whom I trust.

Accordingly to my anecdotal sources from a number of LA's , retired sencos (luv ya Mum!). An early statement review is a red flag that they are looking to reduce provision at the earliest opportunity. Remember LA's know the rules lots better than us Mums, they plead ignorance for a reason every damn time. Just a heads up Wink

Thanks. It is school that are talking about holding one and not the LA. I think they are trying to get things back on track wiht the best of intentions as the last review was late but I am not so sure they are savvy to the ways of the evil LA!

For me, AR = opportunity to reduce provision if possible. I'm not sure school appreciate that.

Just checked and paras 9.1 and 9.2 SEN COP suggest that AR should be within 12 months of statement issue or last review.

We had ours last week. The SENCO read out 30 hours pw funding. It was the elephant in the room. Nobody said a word including the LA officer! Phew!!!

My DS's Y5 transition review had to be held before the Easter Holidays and was therefore rolled into the next AR, 3 months early. Your next AR should probably be in Jan but having it in March to include the transition review would make more sense (and delay any potential reduction?)
