I'm trying to work out if I'm bu to ask for more maintenance.
My question: when taking out a percentage for children living with non resident parent is there an age limit to those children?

Ex has older children both started living with him once they'd finished school.
One is hardly there, driving with own car, working full time. Other is working but I'm not sure if full time.

Do I still include these young adults as children on the maintenance calculator?

I think it's the same rules as apply to the age of child you can claim child maintenance for - ie until their 19th birthday, so long as they are still in further educsation (ie doing A levels, etc). But if they are 16-19 and have left school, then I don't think they count and children. So yes, it might well be worth your while asking your ex whether a rise is due now that his step children aren't dependent any more.

It's linked to child benefit. Does he, or his partner if he is living with one, receive child benefit for these children?

If not, then they are not counted.
