Faulty Goods - Do I have to accept exchange or can I have refund?

I purchased a washing machine 3 weeks ago and the touchscreen doesn't work properly on it.
As per the sellers website when I discovered it wasn't working I contacted the manufacturer who sent an engineer out. He confirmed it wasn't working and said parts would be 7 - 10 days but that it was under 30 days old I could reject it as unfit for purchase and that's what he recommended I do. He also said the model I had purchased was rife with these problems and suggested I get a different model.
I used the which template and sent a letter requested a refund, but they have written back to me to say they will swap the machine and to give them a date they can do so.
Do I have to accept a new machine rather than a refund?

I had an issue with my dishwaser. After the 3rd call out i'd had enough. Told them i did not want another engineer to come out, that the machine was not fit for purpose and i either wanted a replacement or my money back. I got my money back as they no longer had my model. My machine was two years old! I'm pretty sure, with the information you have supplied, you are well within your rights to get your money back. Have you read the small print of your warranty? But i'm sure in my meagre retail knowledge that you are within the time frame for a full refund.

I had to stand my ground mind. Don't let them fob you off or string it out (which is what they did to me).

And i phoned them and got ref numbers every time i spoke with someone so they couldn't say they had no record.

No, you do not have to accept a new machine. The wording of any warranty is irrelevant. Under the Consumer Rights Act 2015 you have the absolute right to reject the goods and receive a refund. Don't let them fob you off. If they continue to insist on an exchange, give them a reasonable deadline to refund your money and tell them you will take legal action if they fail to comply.

Thanks everyone. I will press for the refund and see what happens. What do I do with the broken machine? Do I need to get it back to them or do they have to come and get it?

It depends. Did they deliver it to you? If so, they must either collect it or meet your costs in returning it.
