Travel claim - need some advice please

Unfortunately I can't post much detail as I don't want to identify myself but I need some advice please.

I was injured on holiday last year. I had to have medical treatment. I booked the holiday through a tour operator and I am pursuing a claim against the tour operator. I had travel insurance and my case was assigned to a solicitors firm who have been working on my claim. I've just been told that things are 'not looking good' and I may not get any compensation. They haven't quite given up yet but they are pessimistic about the outcome.

I'm upset and angry. My question is this, if the current solicitors get nowhere can I approach another firm and instruct them to pursue my claim?

You can but it's unlikely they will get a different result. Was the injury the fault of the tour operator?

You need to say what happened.

It all depends on the circumstances to be honest. How do you allege the holiday company were negligent? Can you prove they were negligent?

Yep more detail needed I'm afraid. Does your insurance company use a "well known chain of tv advertising solicitors" by any chance?

We need more facts. If the accident was simply you crossed the road and you were hit by a passing car no the tour operator would NOT be liable for anything.

If the tour operator as part of the package had a hired person / activity that was not safe or not maintained to the level it should be (aka a boat that sinks etc) then you would possibly have a claim.

Hence the need for more details to see if it is worth continuing with different solicitors.
