Earlier tonight my neighbours fish pond caught fire through faulty electrics .he was away but his daughters was there and by chance saw the fire and one of their boyfriends put it out with a hose pipe .but his pond is right next to my fence and only about 12 ft if that from my house it’s a semi. I am now concerned if this happens again it could set my fence slight and my house as my fence goes right up to my house attached to my house wall.
He had no rcd connected either.
I may add part of his fishpond is somewhat over my boundary but too much money to go through the courts and it’s not worth it .
So my fence is really close to his fishpond if this fire hadn’t been seen my fence would had caught fire to.
Would there be any legal way I could demand he moves his pond away from being so close to the house.ive included a photo to show fire showing how close it is. I’m very fire conscious I don’t keep anything flammable in my wooden shed or anything such as electrics in there .

I can't see how the pond can be over the boundary. Does not the fence mark the boundary?

Nothing you can do to get it moved unless they've cut away a part of the fence and built the pond through it.

Electrics clearly unsafe. Prob not done by qualified electrician. Just tell the Fire Brigade and they will come round and give him “advice”.

I,ll explain. Ok he brought his council house back in 2003 back then no fence. Then he built this fishpond.i was a council tenant had no boundary plan but knew it was my boundary but as no fence not sure where exactly.
Then he built a picket fence which over the years deteriorated.fast foward to 2016 I brought my council house when boundary was measured was told his fish pond was somwhat over my boundary and some of his fence. Council said it wasn’t worth the expensive to them of making him move it.
Then after I brought it as his fence was falling down asked his permission like you do to have it removed and my own fence put up.
He gave permission but shortly after my fence was put up he wrecked it by pushing on all the panels . In court he claimed it was his boundary and my fence sat within his boundary and therefore it was his fence so he had only damaged his own fence. Yes I had my boundary plan in court but was amazed the magistrates didn’t ask to see it or his boundary plan I had a copy off so basically he got off. By the way my fence is actually not even on the proper boundary line some of the length cos his fishpond in the way.
I looked into reclaiming my boundary there but the costs was very expensive and I didn’t want to get into a boundary dispute

That’s why I added the photos lol it was the platform for his terrapins to climb out onto that caught fire.

His daughter did call fire brigade as I told them it could smoulder but no fire engine came so they must had cancelled it.
He wired it up himself and he is not a electriction .

The only way you could sort this is by a full on boundary dispute. If he currently believes that the pond is on his land, or doesn’t care that it’s on yours he won’t move it. People can have ponds right up to their boundary.

As I plan to sell in a few years lawyer told me I have to disclose any boundary disputes and it could affect selling my house.
When I court he was in full knowledge it was my boundary as in the past he has referred to it as my boundary not his.
He has a boundary plan showing his boundary the other side.
But he needed to steer it away from a criminal damage charge so made up all these lies.i was disgusted with the magistrates as they concluded as there was no proof who owned the boundary the case was dismissed .i told the court I had with me in court my boundary plan and a copy of his proving it was my boundary. So the justice system stinks and he got off with causing £1000 of damage to my fence.
So yes I was pleased to see his pride and joy his pond going up in flames ,karma. Ok I was more than pleased lol his fish was ok I wouldn’t want them harming but one side of the pond is so burnt and charred and his platform his terrapins go on is wrecked . He built it himself out of wood .
