Divorcing but hopefully staying in house with kids

What happens if court say I can stay in the house with the kids till they are/full time education. Is it then a 50/50 split. I dont have any assets only debts he left me with in DV. We have no picassos just ikea. The cars not worth much abut £850. Im not claiming spouses maintenance.

Not necessarily 50:50. My sister had a mesher order which meant she could stay in the house till kids 18 then it was a 70:30 split (based on house price at that time) Will depend on your own set of circumstances.

Are you in a financial position to take on mortgage/outgoings on fmh?

No he left me with no job/money/assets.

If you can't cover the mortgage the court is unlikely to grant you the house as you can't afford it. Have you made attempts to gain work?

Unless he's a high earner there's no way he'll be expected to pay the mortgage but not able to live there. If you want to stay there with the children and are awarded that at court then you'll need to be able to pay the mortgage yourself. If not it will have to be sold and you'll have to get a job and rent somewhere.

We have no mortgage. I have worked since I was 16 upto last year. I was the one that was the bread winner to purchase home in first place. I have never been selfish in marriage only kept good home and kids and kept jobs. Its only when we moved he said you dont have to work hence reason I dont have job. Would I like one OH yes. Im from family of workers and always will be. All I want is to look out for my kids future

Just to let you all know that I decided to sell house as I got my money back from what I put in before marriage, plus half of assets and then he was hiding money. I dd get result but I know thats not everyone story. I was lucky one. Im moving on and there can be a silver lining
