Parking ticket, CCJ & change of address

Just had a bailiff turn up at my door Shock Apparently for an unpaid parking ticket. First time he knocked I got cross(ish) saying we had paid the ticket, knew we had as I was sat next to my dh when he paid. Gave me the letter, went back to his van. Second knock, he'd phoned our Council, found out that it was a previous ticket (no idea how my dh has clocked these up Blush) from May 2013 which was sent to a previous address. We've been at this address since October 2012, and I've just checked the log book, registered at this address since that time.

My question is how the hell has the Council managed to fudge up our address, given that the log book is at the right address, and we've been paying our council tax in full at the current address? What does this mean for the CCJ now on my dh (and our property)?

If they have served the summons on you (or your H) at an old and incorrect address (when they should have known from the registration documents that the car was registered to your new address) you should be able to have the judgment set aside. I suggest you write to the council and ask that they agree to the setting aside of the judgment on you paying the original fine.

Thanks for your help. In the meantime, what should we do about the bailiff? He has a warrant for the seizure of the car. I never thought I'd be on the wrong end of this discussion!

Hide the car or sell it to someone until the matter is sorted. Back up all your conversations with the council in writing ( recorded delivery). My experience with Brent council and a parking ticket was horrendous. They ticketed me parking on nhs land (whom i was working for) but took months for them to stop threatening me with court action. It should be so clear cut to sort out this kind of thing but when you're dealing with cash strapped councils they make it so hard and you never speak to the same person twice....
