Promotion on maternity leave

Hi all,

I was hoping someone could help...

There has recently been a restructure at work and I applied for a role at a slightly higher banding than my original one. I interviewed and got the role. The new manager says he will need cover until I return from maternity leave.

I was under the impression that the changing to my banding should be effective from now rather than when I return to work but this doesn't tally with what my work is thinking.

Appreciate any responses!

Do you mean a pay rise? I don't think you'd get paid more when you're on ML unless it's a company wide increase. Because you're not actually doing the new role yet?

You would have to negotiate a start date for the new role with your employer, but I doubt they would be inclined to set that start date as now. The same way as if you applied for a new job with a different company whilst on mat leave you wouldn't expect them to start paying you until you actually start.

Apologies for the duplicate thread...I'll report it.

There wouldn't be a pay rise...the new banding mean that I may be eligible for a pay review which I would miss out if the new banding didn't come into affect.

Responses have been useful as whilst I know I'm not physically doing the role...I've filled the vacancy and associated banding....most of the HR department think I wouldn't get the banding but some seem to say yes hence the confusion!

Maternity pay is calculated based on what you were paid at a certain stage of pregnancy. Any changes after that aren't relevant.

I was successful in getting a promotion to a higher banding in my first month of maternity leave. The role was covered whilst I was off but I did not start the new higher band untilI returned from mat leave (NHS)

If it was a restructuring presumably there's a date it takes effect? You be certainly move roles during maternity leave even if you don't actually start work until you're back.

I’m far from an HR expert but it seems the fairest thing would be that the pay review is completed as if you were already in post which forms your salary when you do return and you continue to receive your current level of maternity pay until then. This is assuming the pay review is taking place on a fixed date.

That sounds at you’re not getting paid in advance for a job you’re not doing but you’re also not disadvantaged by the fact that you were on maternity leave.

Hi all. Just wanted to update on the latest as I had a few different opinions on the thread.

My higher role will be implemented from the start of new org structure this month so I will already be in the role when I return to work.
