New job, holidays not carried over

Hello, I joined a new company in January and planned to use my holiday entitlement for this year in August and October. But today I realised that the holiday year in my new company starts on 1st July, so I lost my 12.5 days of holiday allowance for the first 6 months. No one has ever told me that I'm about to loose these days. Any ideas what I can do now? Many thanks

Shock !

Your manager or HR should have been talking to you about your outstanding holiday.

Was it set out in your contract / staff handbook when tne holiday year is?

Have you spoken with your manager about it? Surely you have already needed to book August time off?

It's not that unusual for there to be no automatic carry over, and often you'll only be allowed to carry over 5 days.

It would have been helpful for HR to remind you of your entitlement but no obligation for them to do so. And a smaller company without HR might not do that.

I think you should explain the situation to your manager or HR. But you should also be able to use this year's allowance for Aug and Oct.

It's definitely mentioned on the system, need to check my contract, but tbh it's first time I come across the 31-June cut off date

I can see how its happened and maybe HR should have spoke to you. But you also have some responsibility for it as well.

What did they say when you booked the holiday with them? Is it coming out of next years allowance?

It's a huge bank and not sure how cooperative the would be in allowing me to actually use my entitlement from the first 6 months now

My boss never mentioned that, he just said 'let me know when you want to take your holidays" and was happy with august&october (we discussed it in June)

And yes, just checked and it's stated in my contract, but I never read the benefits section just my responsibilities, silly me

You may have been allowed to carry over a limited number of hours, had you agreed it in advance.

LIZS, no, didn't know I was going to loose my entitlement, I usually use all my entertainment and sometimes even buy extra holidays. Need to send a request to HR on Monday and may be talk to my boss

Speak to them they may allow it. Maybe not the 12.5 days. But worth asking.

You can still take the holidays out if the new yesrs entitlements though, cant you?

Yes, sure, I can and will do as we booked them already, but it would mean no holidays in Jan-June next year.

It was foolish of you not to read your entire contract. You're signing it, it's a legal document for heaven's sake. You made an assumption that the holiday year is the same in your new job as previous places you've worked (which is also foolish as it can vary from employer to employer). Why didn't you check this? All this information will be readily available on your employer's intranet site.

Most banks allow you to carry forward 5 days leave BUT this usually needs to be approved in advance by your line manager. In some companies, you need to demonstrate that that there was a valid business reason why you couldn't use the holiday that you want to carry forward. Banks are getting much tighter with this. My last employer had a very tight and specific policy on when carry-forward was allowed. Not getting your act together to book holiday is not a valid reason. I denied approval for a carry-forward request for one of my team in a situation like this. He just hadn't bothered to make the effort to use his holiday and thought he could just casually carry 5 days leave forward. Even IF I had approved it, it would have been a policy breach and HR would have denied it anyway.

OP I suggest you speak to your boss on Monday and throw yourself on his mercy. At best you may be allowed to carry forward 5 days. But it is also quite possible that you've missed the window and you will lose all 12.5 days.

The auditors of our company have advised that any holiday carried forward must be shown as a liability against the following year, and quantified, as the organisation is left potentially weaker if staff have extra time to take off.

The time and admin involved in this have led us to put a stop to carrying days forward. BUT managers are expected to plan and manage holidays of their team members over the year, ensuring that holiday weeks are spread out amongst team members, workloads can be managed around leave , and that everyone isn't suddenly off in the last month using up days of losing their R&R holiday time.

Why cant you have holidays jan-jun?

You have a full year of holidays to use before june 2018.

Because I booked my holiday allowance 5 weeks in for august+October assuming it was for 2017 entitlement, but it would actually cover july17-june18 with nothing left till July18

Do you only work pt? Still not sure how 12.5 would be a full year's allocation otherwise.

Lizs 12.5 is her allocation for half if the year. So 1st July she gets 25 days. She is using the 25 for Aug and Oct.

So you booked a whole years entitlement in two sections without checking what the holiday year?

I do hope they can something but holidays are reallyvyour own responsibility. As pp said above it often classed a liability

Thats what I was trying to get at, but why would she then have assumed she could still book 5 weeks off as her full allowance before Jan 2018?

But you'd not be able to receive more than your allowance. So if op believed she only had 12.5 days to use until Jan she can't request and expect 25 to be agreed. Either she only works 50% in which case 12.5 would be 5 weeks or she misread her allocation to end June as her annual allowance, but in most people's eyes that simply would not make sense as the statutory amount is more.

No she started in Jan 2017. She assumed she had a full allocation of holiday to use until Jan 2018 and booked holiday in August and October.

What actually happened was she joined half way through the holiday year and should have used her allocated days (12.5) before they expired in June 2017. She hasn't so they've been lost.

The new allocation has started and will be used for her August and October but that has to last her now until June 2018.

No one warned her she was about to lose the 12.5 days.

I thought she was told her allocation would be 12.5 days not 25, but maybe that was only after she lost it.
