Hi, I am 22 weeks pregnant i was employed with my firm for over 4 years as a secretary. Back in August i changed roles and became the credit controller (before i fell pregnant). A replacement secretary was employed at the beginning of August. She is now leaving at the end of the month (January). i was told on Monday i would have to go back to my old role as secretary full time and do credit control 3 days a month. They would not employ anyone until April (as that is when i go on maternity leave). After my maternity and during my maternity i will be able to KIT days on the credit control and after i return to work i will be the credit controller again. I do not want to go back to being a secretary, as the replacement has left the department in a mess and its a very busy stressfull role.

I did tell the boss i do not want to go back to the old role and he said that he did not want to employ anyone until i was leaving, as he did not want to pay agency fees etc.

My firm de-merged from another firm and last year and my contract has not be re-issued. I received a letter when the de-merger happens confirming that i was now employed by new firm and my employment duration and rights were carried over and that new contracts would be issued.

I need to know what to do, do i have to take my old role back. or can i insist that i stay put in the credit control position.

Help please

Ring ACAS, the employment rights helpline. They're brilliant. They helped me when I had problems with work when I was pregnant and back from maternity leave. They'll be able to tell you where you stand legally. It's a government run thing I think so it's free calls and free advice.

I'm not sure about this but I'd dodge going back to the secretarial role before you ring them in case moving is seen as acceptance of it or something?

Did you have a letter at the time you changed roles confirming it?
