When can a case be escalated and what is likely to happen?

I bought an item which is a different size to what was stated twice in the listing. I told the seller I wanted a refund and if she wanted them returned I wasn't willing to swallow the return postage cost as they weren't as listed.

She refused saying I could send them back but she wouldn't refund the postage. I wasn't happy with this so opened a case.

I don't know how the seller's side of the case looks (ie what options they give her etc). She has responded saying basically the same thing as saying that I'm lying about the size. I tried to send photos of the size label to the email address on her paypal account but it said delivery status failure. I've offered to send the photos by email if she wants but she's ignored that. She's just going on and on about me lying etc and hasn't offered to resolve the issue fairly.

Is there going to be a point when I can escalate this case as we're unable to come to an agreement? And if so when will that happen? I'm sick of her endless agressive emails! Sad

you can escalate in 10 days

you can ask for return postage costs, but I don't think your seller will give it

you will get a full refund of the original item and postage

And of course once over leave appropriate feedback and stars

oh and ignore all emails and don't reply - just calmly state your case in the resolution centre and leave it at that. It will just annoy and upset you if you keep emailing back and forth, and no one will get anywhere with that.

I know, I've told her I won't respond to anything unless she's willing to give a full refund. I doubt she will so that's it. 10 days will seem like a long time if she carries on at this rate! Sad

If you make a claim through paypal or ebay then you'll have to return it signed for at your own cost if the seller wants the item back. If they find in your favour then they refund the price plus the seller's postage costs but you won't get your own back

I have never waited 10 days to escalate. If you're not happy then do it now.

you do have to wait 10 days to escalate if the case is with eBay

A paypal claim can be escalated immediately.

I agree with all of the above.
Just wanted to add that I have won 2 cases in the past when I had stated in the resolution centre that I wasn't prepared to pay for return postage myself but was happy to package up etc if the seller wanted to organise a courier. I got a full refund including initial shipping costs
One was a broken pushchair which was totally mangled and dangerous and would have cost a fair bit to courier back.
Neither seller bothered to organise getting the goods back and I was left to dispose of them. I think some sellers are just prepared to chance it. Ebay seems to favour the buyer massively so you should be ok (but has really put me off selling on ebay because I think it's only a matter of time before I get swindled)

mummymarket it happened to me the buyer said item wasnt right made out he wanted a dress for wifes birthday and wasnt opened case againist me yes and seemed me they more in favour on the buyer he got all his money back including postage and did not send my item back so i will never do selling on ebay again i was conned.
