The sharing of bills

Hi all,

Just a quick question, my husband moved out to live with his girlfriends ( yes I did say girlfriends) and he has paid me nothing to maintain the home.

I was working part time but I have been so stressed and the divorce has been so traumatic I simply have found working on anything meaningful not quite possible just yet.

To add to my woes, the ex came to the house, broke a big glass door , ran up a parking fine ticket which meant bailiffs came to the house to seize goods. If I hadn't paid off his debt, they would have taken stuff.
There also was a big leak on the kitcyroof not to mention shower room which both have required fixing at ££££££ . He refuses to go half on these costs despite polite requests.

I hold a small sum which is due to be split between us. The court order makes no provision for these bills but I want to deduct them as it only seems fair as he is half owner of the property.

Is it a legal requirement that co owners share responsibility of maintenance of Home before it gets sold?

You need to check the wording of your consent order. IME - as you live there you pay all bills and upkeep.

A tricky area.

IMO split liability only applies during the marriage.

If the roof caves in after the marriage has ended, you could have a case that the person who left is no longer liable.

On the flip side it's in both your names.

Document everything.

A joint mortage only means your responsible for the mortage imo.
