Refusing to sign the divorce petition

So my husband is now refusing to sign the petition, what happens if I pay to have him petitioned again and he still refuses to sign.

I THINK if you get it sent to him with recorded delivery or hand deliver (serve it?) & have proof he has received it - then after a certain amount of time they will let it proceed without it being signed... I’m sure I read that

It depends - if you can prove that he has received the petition, you can proceed without his signature. My STBXH initially refused to sign - and sent me a text saying that he had read it and wasn't going to sign. Which would have been enough.

If you don't have that, you can apply to have the petition served by a process server - it costs about £100 and it may well be that he will have to pay that, not you. And the server's statement will then be enough to proceed.

He can't stop the divorce unless he contests it - which would cost him a fortune and is likely to fail.

Mine did sign in the end and we are back on reasonably civil terms at the moment.

There’s a suggestion from his solicitor that he may contest
