To think this is wrong (ebay)

My phone randomly broke (just switched off and never came in again) i couldn't afford to buy a new one so I won one on an eBay auction. It was due to be delivered Saturday or Monday just gone, I paid immediately when the auction ended on Thursday anyway it never arrived. I checked on Monday and it was still marked as not dispatched, I messaged the seller and asked when they would be posting. They have not responded and have ignored all messages. I can't afford to pay out again for a new phone but ebayt say they have till the 30th to respond. And won t refund me till then meanwhile I'm without a phone aibu in thinking this is wrong? It's not even been dispatched.

Yeah it is but there's not much you can do besides wait now unfortunately, atleast you'll get your money back though. make sure you give the seller a shitty review though!

Just as a side note though, isn't it funny how freaked out people get when they don't have a phone for 5 seconds? Grin Sometimes I miss not having one :p

Agree to give them a shitty review, if it's any consolation sometimes I find the item has actually been dispatched the seller just hasn't updated the status.

I'm not freaked out, I have a disabled child at school so need a phone as the school calls me frequently, I only have my house phone now and they tried to contact me and couldn't get through to me as I was out and no phone.

Every now and then my phone switches itself off when it is out of charge and cannot be switched on again, even when charged. Except it can be switched on with about 10 minutes minimum charge by holding down the on/off button and the volume button at the same time. Have you tried something like that OP?

It's a poor show by the seller but it's understandable that eBay expect more than a few days to have passed before they will intervene.

Just a thought, but why not buy a cheap (£10) PAYG that uses the same network as your main phone so you can just swap your SIM over to it. Will keep you going until your new phone arrives and can be kept for any future issues with your main phone.

Some people have old/ spare phones lying about, could you ask your friends and family on social media if you could borrow one until your new one arrives?

And yes, you are more than within your rights to leave a bad review- maybe making the seller aware of this could print them to dispatch your phone sooner Grin

Unfortunately the old phones well and truly dead. I thought a bout buy ing a cheap phone but then you now have to buy £10 credit with it as well. So doesn't work out that cheap . Just can't see why ebay won't refund me considering it hasn't been dispacted. It's been a week.

It's not right, is it? You usually have to agree to post items within a specified time, and if you don't (eg within 3 days) then buyer should be able to get refunded - unless seller is being co-operative and has a valid reason for not posting. Do you think you got it cheap? Some sellers decide it went too cheap and just decide not to sell - I've seen it mentioned many times in negative feedback on seller's profiles. The fact that your correspondence is being ignored doesn't bode well, unless the seller is one of those business sellers with thousands of feedback - in that case they may just be really busy. Open a non receipt case as soon as the system allows you to.

You don’t know it hasn’t been dispatched though (just that it hasn’t been marked as such). What dates were given for estimated delivery?

I really do think it's because it went for less than they wanted. I was happy to get it for £45 as it generally sells for 15-20 pounds more.

I have heard of people doing this when they want to borrow some money very short term or until payday. Put a few things on eBay, get paid for them, use the money, payday comes around, refund the person on eBay.

Frustrating but not unheard of. Maybe the seller is ill or gone on holiday? Give it a couple of days then open a case saying you haven't received it. It might be lostbin the post. Not many private sellers mark as dispatched ime. You'll get your money back at least.

I've opened a dispute but they have till the 30th to refund me, they have ignored my messages so doubt it's lost in the post as they would have replied surely.

Think it was 2014 and they have a few reviews stating the item wasn't sent. Should have read them before I bought it.

Have you opened a dispute with paypal?

You can open a dispute with both ebay and paypal.
