here

So basically his victim is just a fall guy for the trauma he suffered because someone raped and killed his sister

I have no words ...

This is how little women matter.

He was ordered to pay the victim a surcharge of £20.

She was 12.

The victim surcharge is paid to the court not the victim - its basically applied to every court fine and I believe goes into an overall fund used to help victims. She would be entitled to claim statutory damages which varies according to the injury suffered, if the perpetrator cannot be sued directly (ie has no money)

I'm Appalled. There's no possible way to excuse raping anyone, especially not a child.

Oh my goodness, that's terrible. I can't believe that's in the UK. Is there anything we can do?

Holy shit that's horrific! I have a 12 year old dd and am also friends with somebody who's nephew lives with her following the brutal murder of his mother, so if said boy raped my Dd there would be no recourse?! I've heard it all now Shock

This is disgusting. I cannot believe that a supposedly intelligent judge can talk about the effects on this poor girl and at the same time tell the purpetrator that he will he spared jail because he is worried about how he will cope. Awful. This sends the message to the victim that what she went through wasn't as bad as what the perpetrator went through, so it doesn't matter. Poor poor girl. Sad

What's the process for getting lenient sentences reviewed? Is there any way public lobbying can trigger the process? The lad sounds like a threat to the wider public. I guess we'll just have to wait for him to do it again before we get a proper sentence and recognition of the danger he presents... Hmm

I bet the prosecution are planning the appeal of sentence already. That's ridiculous!

He raped her three times. Three fucking times. That poor little girl.

He was so upset about his sister that he raped a child three times? Fucking hell. He absolutely should be in prison. Angry

Bloody hellfire.

That is twisted. Look at the timeline! His sister died in 2011. If he was 16 or 17 at the time of this rape, and 18 now, then it must have happened last year or the year before, so a minimum of 3 years after her death- we are not talking about a grieving person inexplicably losing his way in the immediate aftermath of a sudden death, this is a significant amount of time later.

There really is no end to rape apology and excusing, is there? I'm sure rapists always have their "reasons", but that sentence is a slap in the face for that poor child. 12 years old! Fucking hell.

I don't have the words to express my horror and utter disgust at this man and this judge. Sad Angry

I just re-read my previous post and wanted to clarify - I don't for one minute think his actions would have been excusable, even had they happened the day after his sister died. I'm just saying that the events couldn't even plausibly be linked in any way. Horseshit from go to whoa.

How is a child meant to understand that, having gone through the trauma of a court case after repeated rapes, her abuser is not being sent to prison?

I suspect the judge was motivated by sympathy for the criminal's parents, who have been through an appalling ordeal with the death of their dd but they are not the victims of this crime.

msrisotto · 16/01/2016 07:54

There aren't words to properly express my disgust at this bullshit. There has to be some recourse against the judge for making such a fucked up decision? Is there a way to raise hell about this? WHY don't people care about women FGS.

The prosecution can appeal against the sentence if they think it appropriate. Bear in mind that we don't have all the detailed information that the judge would have had.

Literally raging at the injustice that has been done to this 12 year old girl, there is no justifiable reason/excuse that can be applied to this situation.

Report
Idefix · 16/01/2016 08:21

The bbc thing says very little about the girl, no doubt there will be drips of information about her 'looking older', 'being up for it', 'giving mixed messages' if the story takes off.

This makes me feel physically sick that as a society we are no further forward than this.

SitsOnFence · 16/01/2016 08:23

Surely, if he's committed a horrific crime but been judged to not be of sound enough mind to take full responsibility for his actions, then he should be somewhere like Broadmoor, where he can get the help he needs, whilst not being a danger to other children?
