The victim surcharge is paid to the court not the victim - its basically applied to every court fine and I believe goes into an overall fund used to help victims. She would be entitled to claim statutory damages which varies according to the injury suffered, if the perpetrator cannot be sued directly (ie has no money)

Holy shit that's horrific! I have a 12 year old dd and am also friends with somebody who's nephew lives with her following the brutal murder of his mother, so if said boy raped my Dd there would be no recourse?! I've heard it all now

This is disgusting. I cannot believe that a supposedly intelligent judge can talk about the effects on this poor girl and at the same time tell the purpetrator that he will he spared jail because he is worried about how he will cope. Awful. This sends the message to the victim that what she went through wasn't as bad as what the perpetrator went through, so it doesn't matter. Poor poor girl.

What's the process for getting lenient sentences reviewed? Is there any way public lobbying can trigger the process? The lad sounds like a threat to the wider public. I guess we'll just have to wait for him to do it again before we get a proper sentence and recognition of the danger he presents...

That is twisted. Look at the timeline! His sister died in 2011. If he was 16 or 17 at the time of this rape, and 18 now, then it must have happened last year or the year before, so a minimum of 3 years after her death- we are not talking about a grieving person inexplicably losing his way in the immediate aftermath of a sudden death, this is a significant amount of time later.

There really is no end to rape apology and excusing, is there? I'm sure rapists always have their "reasons", but that sentence is a slap in the face for that poor child. 12 years old! Fucking hell.

I suspect the judge was motivated by sympathy for the criminal's parents, who have been through an appalling ordeal with the death of their dd but they are not the victims of this crime.

The prosecution can appeal against the sentence if they think it appropriate. Bear in mind that we don't have all the detailed information that the judge would have had.

The bbc thing says very little about the girl, no doubt there will be drips of information about her 'looking older', 'being up for it', 'giving mixed messages' if the story takes off.
