Part-time and Bank Holidays-again sorry!

OK I know it's been asked before (sorry) but if I work part-time how do I work out my bank holiday entitlement? Does it differ if work Mondays or not? What happens if I work the bank holiday? What happens if I am available to work the Bank Holiday (I understand I need to book them off) but my employer doesn't use me, does it count as a free day?

There are different systems as to how it can work in practice. But I think that legally if you work 80% of a Full timer you are only entited to 80% of each bank holiday.

One way that this can be applied in paractice is that if you usually work Mondays you end up using 0.2 days of your anual leave to take the day off (which you may be forced to do if your employer shuts down). But if you don't usually work Mondays you are still entitled to 80% of a bank holiday which gets added to your annual leave. Thats how my employer works it anyway.

It's usually calculated pro-rata based on how many days you work (whether you work mondays or not). there are 8 bank holidays a year, so if you work 50% of full time, you get 4 days off.

but it depends on your employer - the don't have to give you bank holidays - they just have to give you 4.5 weeks off a year in total. so in answer to your question - maybe, maybe not. why don't you ask your employer?

The way it works at my work is that you get the bank holidays prorata depending on how many days you work.

If you are then entitled to more bank holidays than fall on your working days then the extra gets added to your holiday entitlement.

Senora my employer has a long history of not paying maternity leave properly, pensions properly, paying properly, making 'illegal' deductions etc etc so thought I'd ask the experts first

I work 18.5 hours per week and am therefore entitled to 50% of 8 bank holidays off.

The easiest way to work it out is calculate in hours the number of hours you work in a year, adding on 50% of the 8 days bank holiday (28 hours). Every time you take a day off you subtract those hours, if it is a bank holiday on a day you don't work ignore it and if it is one you'd work you subtract the hours!

as most people either work mon or fri this works.

Ok so say you work 50% of the working week,and there are 8 bank holidays you'd be entitled to 4 bank holidays.

If you work say tue, wed and half of thursday and all the bank holidays fall on a mon or fri then you should have 4 days added to your normal holiday entitlement.

If you work mon to wed, and 3 of the bank holidays fall on a monday then you'd have to take those 3 mondays off and the extra day would be added to your normal entitlement.

That's the way it works at my work anyway.

If you work the bank holidy then you'd get a day in lieu as per normal.

I'm going to cut and paste from a thread from a couple of days ago about bank holidays and calculating part time entitlement -

In terms of pro rating them, as a part timer you can't be disadvantaged when compared to a full timer.

For 'normal' 5 day weeks I usually advise managers of part timers to divide 8 by 5 then multiply by the number of days the part timer works each week. Then look at the calendar and see how many bank holidays will naturally fall on the part timer's working days - this will vary depending on the days the person works and when Christmas and New Year fall.

Then the part timer may have days to make up or extra days to take.

So if there are 8 bank holidays for people who work 5 days a week, and you work 4, you will be entitled to 5 of them. You should look at your calendar each year, see how many of the normal bank holidays fall on your working days, and make an adjustment up or down appropriately to the number of days you work.

You have no automatic entitlement to bank holidays, you have a right to 4.8 weeks off work, which can include bank holidays, and you have a right not to be disadvantaged compared to a full timer at your place of work.
