can someone help me work out how many days holiday i get please?

I work part time mon-fri and this is what it says about holidays in my contract.

You are entitled to 22.4 days' holiday during each holiday year. This includes the usual public holidays in England and Wales or a day in lieu where we require you to work on a public holiday.

It then goes on to say (in another paragraph)

We require you to take holiday on specific days as notified to you which are 11.2 days chosen by your employer.


I am really confused... does this mean I get 22.4 days that I can choose myself PLUS a further 11.2 days that my employer chooses? Or do we get 11.2 days each? And where do bank holidays come in? I mean, by the time we take into consideration bank holidays, I am hardly left with any holidays :/ Please can someone help me here!

I would say that 11.2 days out of the 22.4 days are chosen by the employer and you get to choose the rest of them yourself (subject to the availability of holidays). Maybe the ones chosen by the employer are the bank holidays?

You get 22.4 total. So that 22.4 includes 11.2 days that your employer tells you when to take
11.2 days, the dates to take are chosen for you.probably to meet service needs

I would say that 11.2 days are chosen by your employer; some of which might be bank holidays.

How many hours a day/week do you work? You should get 5.6 weeks of leave a year; which include bank hols. If you [for example] work a standard 5 hours a day rather than 7.5, you would get [5/7.5] = 67% of what the full time people get which is .67 x 7.5 x 28 = 140.7 hours; but if you work the same hours a week you should still get 28 days leave a year [=140 hours].

Okay thanks...Yeah because there are 8 bank holidays through my working time. And I already know they are using their 11.2 days holiday next year in bulk...so it doesn't really seem fair to leave me with only 3.2 days to choose from because the rest are bank holiday. Hmmm.. I guess I will have to speak with them.

thanks for the other replies... The 22.4 days is definitely worked out correct, I have worked it out now. I was mainly confused about the bank holidays.

I am just kind of gutted that I hardly get to choose when to take my own holiday

Whats that got to do with it?

Any employer can say that they decide which days their employees take their leave, they don't need to inform them of this at interview.

It's self evident question.op feels aggrieved about leave being designated
I'm asking was she aware this would be case that half her leave chosen by employer
Employers approve leave yes,it's less common to firmly designate 11.2days that employer chose

She evidently wasn't aware or she wouldn't be asking now...an interview is to see whether you are suitable for the role, not to go through the full list of processes and procedures. It is not uncommon for employers to designate leave; Christmas, bank hols, a week or two in the summer; all times that employers make decisions about when leave can be taken. Very common.

I work 5 days a week but part time hours. Yes it was made clear that they choose half (I have now looked back at emails) but as I am sitting here working it out I realised how difficult it will be because of the bank holidays.

I also work a lot of overtime (where available) so will that come into account?

Is it really that uncommon - plenty of small businesses, especially in manufacturing do summer shutdown or Christmas shutdown.

Be aware unpaid leave is at employer discretion,they're not obliged to offer it

You only have "3.2 days to choose" if you assume that (a) your employers will never choose a bank holiday as your allotted holiday as part of their entitlement and (b) you will always request and be granted all 8 bank holidays as part of your own entitlement.

Neither of these are actually reasonable assumptions

fish I am aware that I need to speak with my employers regarding the bank holiday situation, maybe I will make sure that half are theirs and half are mine?

I will work some of the bank holidays (the one in August, for example) as I really am not bothered about them. It is mainly Christmas which I was concerned about and possible easter (although not too bothered there either)

As you work 5 days a week; what explanation, if any, have you been given for receiving less than the statutory minimum 28 days a year paid holiday?

Now this may make a difference OP because your 22.4 days has been worked out pro-rata because you are presumably working hours which your employer considers 80% of a "full time" hours. This means that whenever you have a day off this should be counted as 0.8 deducted from your 22.4 days, NOT 1.0.

You are entitled to 5.6 weeks of paid holiday each year, which usually includes bank holidays, so the number of hours of paid holiday you get should equal 5.6 x the number of hours you work each week.

HOWEVER, my dear, you are still being a bit obtuse about bank holidays - you can't "make sure" of something that is at their discretion. They have the right to ask you to work bank holidays if they need you to. If you don't want to, you can request leave, but they are not obliged to grant it.

She works part time hours 5 days a week; so will be entitled to 28 days a year at those part time hours. So if she works an hour a day, she will be entitled to 28 days ie 28 hours.

Until she tells us what her hours are nobody can tell her whether she is being short changed or not.

If you work 5 days a week, the same as a full time employee, irrelevant of the number of hours worked, you are entitled to the 5.6 weeks of holiday! If that is the case OP, then you are being illegally short changed!!!


If full time employees work 6 days per week compared to your 5 days then you are entitled to pro-rata holiday.
