Aspergers, statements and exclusions?!@?!

Hi,

DS is 9 and in year 4. We are certain he has AS, and although we don't have an official DX, this has been confirmed by several professionals including the schools ed psyhcologist - but not by a peadiatrican(sp) or anyone 'official'. We are awaiting a referal for this.

He's been having big issues at school with his behaviour. We have to meet with the school and LEA on tuesday as the Head (who will here after be refered to as the Wicked Witch!!) has said she will be pushing for him to be excluded permently.

He doesn't have a statement, although we are in the process of applying for one.

Can anyone offer me any advice for Tuesday? I know that Wicked Witch will be doing her hardest to get the LEA to agree to a perment exclusion.

I aknowledge that DS's behaviour is unacceptable, however I do not feel he poses a danger to himself or others. I think it would be unfair to exclude him whilst he is under assessment for a statement and a DX. I believe that they should keep him in his current school until we have the statment (hopefully!) and a proper DX, and then once we know what his needs are, it can be properly decided where these needs can be met. I have no doubt it will not be at his present school, but where else can they send him without a statement and DX.

Exclusion 'rules'
The Head must write immediately giving length and reason for exclusion.
The Head must inform the Governors only if
(a) an external exam would be missed or
(b) if the total days excluded in the term are more than 5.
The Governors must meet only if
(a) an external exam would be missed or
(b) the total days excluded in the term is over 5 and parents ask for a meeting.
Parents have the right to make 'written representations' which must be considered by governors and/or to attend the meeting.
The Head must inform the LEA only if exclusion means total days excluded in the term are more than 5 or if an external exam would be missed.
If exclusion is more than one day, school must set and mark work for child.
SEN questions
If you believe that your child has been excluded as a result of their special educational needs not being met, you may need to consider:

Asking for your child to be placed on School Action or School Action Plus.
Asking for an urgent review of the IEP.
Complaining to Governors that duties under s317 Education Act 1996 have not been fulfilled (i.e. to use their best endeavours to ensure that children with special needs receive provision to meet their needs).
Requesting statutory assessment.
Asking for a change of school, etc.



Disability discrimination questions
If you believe that the exclusion was unfair, you should consider these issues:

Is my child disabled (as defined by the Disability Discrimination Act)? Download this checklist to find out.
Was the exclusion for a reason related to my child's disability?
Was the exclusion justified, e.g. were there other actions which you think the school could have taken, instead of excluding your child?
Can you think of any reasonable steps which the school could have taken to prevent the situation which led to the exclusion e.g. providing extra support, asking for advice from the LEA, asking the LEA to undertake a statutory assessment?


Note: no child should be excluded for a fixed period if as a result they would have been excluded for more than 45 days in that school year.


Advice on writing 'written representations' for the Governors ?
If you can, give credit where it is due, even if you are angry:

For example, find something positive to say early on in your written statement, e.g.:
"We have been really impressed with the quality of help Matthew has received from his class teacher and with her level of commitment to him ?"
If you accept that your child's behaviour was a real problem, then say so, e.g.:
"We have made it very clear to Matthew that we are not at all happy with his behaviour. We are trying hard to back the school."
Acknowledge that teachers in schools have a difficult job, e.g.:
"We understand the pressures that there are on class teachers in schools nowadays ?"
If you believe that the school has problems due to lack of resources, then say so, e.g.:
"Of course we are aware that there are real problems with resources in schools ?"
But also make clear why you believe the exclusion was unfair:

For example, if the school is aware of Matthew's difficulties, point this out, e.g.
"We explained again, at the last parents' evening, that it is important for all staff to be aware of Matthew's special needs ?"
If you can, give a positive example of how the exclusion might have been avoided, e.g.:
"It would have helped if he had been allowed time to calm down. He reacts badly to orders when he is agitated and he detests physical contact, so ordering him immediately to say 'sorry' and shake hands with the pupil who had been taunting him was not the best way to handle him ?"
Refer to the Government's guidance to head teachers (in Improving Behaviour and Attendance):
"The Secretary of State's guidance to schools says that exclusion should normally only happen: 'if allowing the pupil to remain in school would seriously harm the education or welfare of the pupil or others in the school.' Matthew did not pose a threat to anyone or to himself. In addition, the guidance says: 'Schools should also make every effort to avoid excluding pupils who are being supported at School Action or School Action Plus.' It seems to us that Matthew was excluded without this guidance being considered."
Refer to the Disability Discrimination Act:
"It seems to us that Matthew's exclusion was not justified and that there were 'reasonable steps' which could have been taken to avoid it. For these reasons, and because Matthew is disabled, the exclusion could have been 'disability discrimination' under the Disability Discrimination Act 1995. However, rather than going down the legal route, we would much prefer to try to work with the school in order to obtain the right kind and amount of provision to support the school in meeting Matthew's needs. For example, Matthew does not have a Statement and we would very much welcome the governors' support with our application to the LEA for statutory assessment

Hi

What is his behaviour actually like at school? What one school can't cope with another one can. There may be mainstream school which has had more success and better understaning of aspies than the one he is at. If he is permanently excluded then it is up to the LEA to educate him. They will try and do this as cheaply as possible probablly be offering some home ed - 5 hours a week I think but I don't really know for sure. They will let this drift on for as long as they can in my rather jaundiced view. They might send him to a different school OR they might send him to an EBD. Now these are not brilliant for Aspies but they are better than naught as at least they will have staff that are trained and used to dealing with extreme behaviour.

The one good thing if the head does threaten to exclude him is that it will make the LEA jump and will hurry on the statement process. They will do ANYTHING rather than pay for a child to go to a special school and so they might negotiate with the school and provide 1 to 1 support for him (this might be why the head is taking the stance she is).

Try to be positive during the meeting. I found being very very nice (whilst reading notes upside down) worked.

Very best wishes and good luck. PS. There are Independent private schools for aspies (very expensive but rather good in some cases). You can make the LEA pay if you go down the tribunal route.
