help, old pre school has claimed too many hours

I've no idea what to do. Dtds went to 2 settings but I gave 6 weeks notice (only had to give 4) and they changed to just one setting last November. The one setting has informed me that the other setting claimed 15 hours too many for both my dc and so either dtds finish a week early (and miss end of pre school party etc which won't work as I'm at work) or we pay 15 hours of child care per child. This seems really unfair as it's not our error. Is there anything that we can do to correct the error?

The setting is entitled to keep then funding as you are not really allowed to switch providers during the term.
You could ask the old setting to pass on the money to the new setting but they don't legally have to

As insancerre said. The funding is paid for the term and is based on the children present on headcount day. Children coming and going are a loss or gain to the provider and shouldn't affect a parent accessing free hours. They should have known this when you transferred to them. They cannot bill you for your free hours.

I think that might depend on the LA. In my LA, if parents move nurseries after head count week, they lose the funding for the rest of that term. Therefore, if they want to attend another nursery, then the nursery is within their rights to charge for any hours taken, until the beginning of the next term when the free hours start again.

They've claimed more hours than even if they were there -dtds did 3 hours a week there and the rest of the hours were used where they are now.

Did they not ask you to sign a form that details the amount they claimed per week
When you say end of preschool party do you mean in July or the end of this term?
Because they can't claim for next term if the children arnt there on headcount day

Again, in my local authority, like Insancerre is saying, we require parents to complete and sign a funding form each term to confirm the number of hours their child attends each week. This information is then submitted to the local authority and the nursery receives funding based on it.

From what I recall our LA told me that if i have accepted a child mid-way through the term then I expect to accept a lost, and that I cannot ask my parents to pay a top up; it happened a while ago and basically i was told that it was my problem for accepting the child mid-term. Might me worth a phone call to your LA

I have accepted children mid term and charged the parents for the place as the previous setting had claimed the funding till the end of term
In one instance the previous nursery passed the funding on so we passed this on to the parents
In the other instance the nursery kept the funding and refused to pass any of it on. We charged the parents full price till the next term
I always find out the funding situation before I offer a place
