Forced Sale of Family Home

Hello there,

I'm not sure anyone will be able to help (I do hope so!) but my family has a rather pressing legal matter at present.

My mother was tricked into signed a Deed of Gift when she met my father 22 years ago - unknowingly signing away 50% of everything she owned to him. She had just given birth, and paid for our home in its entirety herself.

4 years ago my father left the family home after a long, unpleasant stretch of violence and abuse and then the Deed of Gift came to light - meaning he could fight for 50% of our family home. They were unmarried partners.

After a legal battle of 4 years my mother and family was evicted from the family home. I was told yesterday that there is to be one last court hearing in which any outstanding applications will be dealt with.

We have never won a hearing in four years as my mother has never been afforded any proper legal representation (at one point she did, and my father managed to get it wrongfully confiscated off her).

I am sure that at the hearing tomorrow, which I can't attend with my mother, that the family home will be sold without her permission. She was told a while ago that if and when a buyer wants to purchase our home, that she will have no say in the sale whatsoever.

Is there anything she can do to get some legal representation within 24 hours for the hearing tomorrow? I really am desperate for some advice; I don't want her to go alone and be bulldozed again by my father's barrister.

Thank you in advance for any help

If she signed it she signed it so I am not surprised she lost. Generally paperwork wins the day. She like many live in partners chose to make a gift.
Also if this hearing is just tidying up final matters like date of sale I doubt there is much legal chance go put in a new witness statement setting out how she was forced (gun to head or whatever). If she were forced why did she not in a year or two after challenge it.

Anyway the question is how can she find representation in 24 hours and without being able to pay for it? You could try the bar pro bono unitwww.barprobono.org.uk/
