resigning from work and entitlement to holiday pay?

working in school as a support worker and got offered job in another school - starting in august . I gave 1 month notice period ( required ) and would leave in August but now thinking -w hat happens to holiday pay entitlement - the contract does not specify details on this - just says 26 working days and can only be taken half-terms/ summer, so not during school term times. Shall I 1) come back to present employer and ask that official date of resigning would be end of august so that I still get August pay for holiday? 2) keep the resigning date - 1st of August and ask the present employer to give me my holiday entitlement pay? would really appreciate replies - as I just released I probably made a mistake with the date? thank you.

Are you asking if you should start work for your new employer while still employed by your current employer but on holiday?

No is the answer. You need to have left the old job by the time you start e new one.

It will make very little difference with your holiday pay anyway, only a couple of days extra would be accrued by you staying employed with your current employer through August.

I see - I did not realise I cannot start work with a new employer if I am on "holidays" with the present employer... Would it be possible to get a just a lump holidays sum before I leave my present job? Would do you mean that very little difference on holiday pay it would be? Maybe I missed something in this. I thought if I was on holiday during August - I would get the full 1 months' payment ( that is why I am so conscious I would not like to lose this entitlement). please help me to understand this complicated situation.

Well you could ask your current employer if they mind you working for someone else at the same time, but don't expect them to say yes.

At the end of your employment you will get paid for any holiday you have accrued but not yet taken. If you get 26 days a year, that means you accrue 2.17 days each month. So you'll only get paid an extra 2 days or so by staying employed through August than you will if you leave at the end of July.

so, if I end my contract end of July - will I get a holiday payment at the end of July ( so July Payment + extra payment equivalent to 25 working days )?

I've no idea, because I don't know when your holiday year runs from and to, and I don't know how many holiday days you've used up this year already.

The point is that when you leave employment you'll get paid for holiday accrued but not taken, and you'll only accrue an extra two days in August.

thank you. I will phone HR today and ask. I have not used any holiday allowances yet. I always take holidays in August, so I assume the year runs from April to April.

I'd be surprised if the holiday year runs April to March if you work in a school- it's more likely to run September to August I would have thought, but your contract, handbook or annual leave policy will say.

If it is September to August and you've taken no holiday since last August, you'll get 11 months worth, so 26/12x11= 24 days
