My DS birthday is 10th October, when would he start at state primary? In the September when he is almost five or would he start in the January before then i.e. 4 and a bit?

He'd start in the Reception class in the September just before his birthday. He could start in the nursery before that if you wanted him to though.

There is no legal obligation to start him until the term following his 5th birthday, i.e. in the January. However, in practice you will probably find that you will need to apply for a place in the March preceding his birthday for a place to start in the September. Many schools only operate a one entry system, which means that he would have to start in the September.
