won an auction and now the seller says that the items have already been sold

Hello I wonder if anyone can help me please. I won an auction on ebay france last night and today have received a message from the seller saying that she had already sold the goods. What can I do? If the goods have been sold, well that really is a shame as it was such a bargain but I want to complain to some one!!! Thanks

Hmm. Most she will get is a rap over the knuckles from ebayHQ, unless you leave her a neutral or negative feedback - which you could in theory as you can't get one back as a buyer these days.
Then she might get suspended - for a while - I have had two sellers email me asking me to remove my neg or neutral recently, as ebay suspended them (or threatened to) over it!
They were both fairly shitty shop sellers with a huge turnover who sent me crap, basically, and wouldn't refund, so I said sorry but no. Feedback is there to warn others.

I don't think ebay can force her to send you the stuff. What a shame. What was it btw? I love to see a bargain!

Also will something happen to my status if I don't continue on and pay for this item, having already recieved the email that I was the winning bidder and to pay for it. Who do I contact for that please.

Report her as a non performing seller - click on help, then search seller non performance, it should come up.

You won't get a strike. Ask her to send you a mutual agreement to cancel the sale, and agree to it, then you'll be fine. I'm just trying to think if she does for some reason file NPB (non paying bidder) against you, which would be strange, if she could actually have a reason to do that - I think the ball is in your court, because you hold the feedback weapon. She will not want to antagonise you further.
IF she does and you get a request to pay from ebay, then pay, and then report Item Not received through paypal and you'll get it all back again! So I doubt she would bother doing this tbh. Don't worry

It was too good to be true! It was 2 lots of riding gear for kids, 2x protection jacket, 2x helmet, 2x box with all the brushes etc, 2x crops and even the offer of boots!! Ok they came from decathalon but I know the jacket alone costs 49.50 euros new!! I "won" it all for 56 euros!! Also there wasn't a buy it now spot on the sale site it was an auction...how frustrating! Now I'll have to go to decath and fork out a fortune for these!! Also P&P was free!

Thanks for your help. You are up bright and early on a sunday morning in the UK. It is 07h10 here and it is going to be our 3rd hot sunny day in a row after 6 weeks of nonstop rain..hurrah

Gosh what a shame she didn't sell it at that. It does make me cross. Mind you I'd be gutted to let it go for that if I was her!
Hope you manage to find some bargains anyway and not fork out full price x

I think she just didn't get enough for it. How much would P&P be on those items? Surely quite a lot. I'd watch her auctions for a while, I bet you it will come up again soon.

Sunny day although we've had great weather for weeks, we're now looking forward to another grey and probably rainy day.

how did you go? I did this last week - was my own stupid mistake listed the same item twice in stead of one unisex and one blue sleepingbag, had to apologise prefusely to the second lady and offer her the alternative (was the same amount).

might have been a genuine mistake - mine was. (was half asleep when listing and didn't notice until they'd both sold.)
