Really ticked off, not sure how to handle this

Dh has been looking for extra duplos for ds1. He recently won a large lot and was quite excited as building things together is a special time for them. It arrived today and they are megablocks (blox?) not duplos. Dh, who is an expert on these things, says that they are not as high quality and don't fit together as tightly as the duplos. I now also find out that the shipping was exorbitant on this purchase. So dh emails the seller explaining that these were not as described. Seller emails back saying basically she wasn't aware of the difference and we can send them back. But if we pay shipping back to her and she only reimburses the bid price (which was implied) then we will have spent more on the shipping costs to and from than the item cost! It seems as though we will probably just keep them, but it makes me really angry as dh would not have bid on them in the first place if they had been described properly.

Not sure what the procedure is jw, but bumping for you - I'd be livid too if this happened to me.

This is the sort of thing that annoys me about ebay and the like
IMHO how can anyone seriously not know the difference between duplo and megablocks - we have got the latter and they are no where near as good as duplo

You could argue with the seller that the item wasnt listed properly

Or relist and sell them on yourself - listed as megablocks obviously!

did u pay through paypal? i think you can also speak toe bay as the item was not as described - mega blox are alot cheaper then duplo aswell.

I had this problem and the answer is, you're buggered really. I bought a buggy described as coming with raincover and sun umbrella but neither arrived. Seller refused to sort the problem so I complained to paypal who found in my favour but the remedy was for me to send back the item at my expense. This would have cost more than buying a new raincover and umbrella so I didn't bother.

Tis crap though. I just had to put it down to ebay bingo. I think ebay's great until you have a problem and then they don't do much to help.

I would expect the seller to reimbuse all postage costs if the item is not what they described. That is their fault not yours. My DP once sold something which turned out wasn't what he thought it was (it was a bike part). We apologised to the buyer and offered them either a refund if they returned the item (we would pay the postage) some money off if they wanted to keep the item.

Our buyer wanted to return the item so we gave a full refund plus the return postage costs and a few quid extra for the inconvenience of having to take it to the post office. It was Dp's mistake not the buyers.

I think the seller would not have a leg to stand on if your reported this to ebay. I would ask either for a full refund including return postage or a partial refund and you will keep the item.

Yurtgirl, I've thought about that but with the holidays I probably won't get around to it and there they will be. I checked the seller's feedback and there are about 7 negatives so she is probably not too bothered about feedback. She's a big seller, too (over 1000) so I guess the odd negative doesn't impact her stats so much

I'm afraid you're right, margoandjerry. Can't believe dh fell for such high shipping charge! And I hate to say anything about it as he is even more upset about the whole thing than I am. I just can't stand the thought of getting shafted. Even if she made an honest mistake in the listing she should step up to the plate and do the right thing at this point.

If you file an item not as described (and you paid with paypal)you will be refunded the amount you paid ie cost + P&P - but you will need to return the item at your own expense (and recorded delivery too)
This may be your best bet as it doesn't sound like the seller will do the decent thing and refund the return postage - but you could return second class rec del.

Don't accept just the refund for the bid price - take it through the dispute and get the full refund

Well, she has responded with an offer to take a miniscule amount off of the total. Dh wants to settle and be done with it but it still makes my blood boil. I sent a reply asking if she honestly does not know the difference in value between the two and suggesting she look at a similar product (like I just did!) in completed listings. I really am tempted to go ahead and file item not as described as they would not have sold at all under mega bloks with the shipping charge she had on there.
