Married but house not in my name

Just a query on something I read on here the other day:

My husband has a mortgage on the house we live in, but it's not in my name at all. We've been married for less than a year. Would this house preclude me from receiving housing benefit? I.e would I be deemed intentionally homeless for moving out?

Really need to sort moving out with our son in the new year, but am now worried that he'd have to sell this house before I was able to receive HB. There's no way he's agree to that, and this environment is not good for any of us.
