Consent order - child maintenance

Hi there

My husband and I divorced (through Wikivorce) last April. He signed a consent order stating that he will pay me £900 per month until our two children leave full time education (they are currently 9 & 4). I didn't demand this amount, he agreed and has been paying it since we separated 4 years ago. I understand that a consent order can be challenged a year after signing and I am fully expecting him to go to the CSA to be reassessed (the CSA calculator shows an amount of £544 a month). Has this happened to anyone before and the CSA have agreed to reduce the amount even though there is no change in his circumstances? when we sold the family home, we split the equity 50/50 and I managed to buy a house with that, a mortgage and a big loan from my Dad, my mortgage provider is one of the few that would accept non court ordered maintainence (at the time) I work part time and could not afford to take such a drastic drop in money.

Hi. I'm in the opposite situation... Contemplating going back to court or the CSA as my ex isn't paying enough according to the formula. As I understand it the CSA formula doesn't consider anything other than "heads in beds" for however many nights and it won't enforce anything over an above that amount. Good luck x

yes, that is correct. It could be challenged. Our court order says he has to pay nothing (as I earn a lot more) and it says that I pay the school and university fees. I could challenge that and clam a % of his income but have not bothered.
