Hi wondered if any one can help. I have an undertaking for ex not to come to property we jointly own. Back in court this week to argue the occupation order. He still has bail conditions not to return to property, can family court over ride this to allow him occupation and force me and the children out? The charge is common assault against my child???

I was told criminal takes priority over civil.

The civil court cannot and will not go against the bail conditions. It is good that you're also going for an occupation order. Gives you more control.
