Pay for KIT days

I'm currently on maternity leave and having a bit of a stand-off via email with our business manager about the rate of pay for KIT days.

The guidance I have found suggests that pay should (but not must - it seems to be nice and woolly) be based on usual daily rate. I assumed that this would be 1/195. According to the business manager the daily rate for teachers is actually 1/365 - something about 195 days in school and the rest being holiday?!

I know teachers in other counties who have been paid 1/195 and the NEU said that this would be their guidance too but, as there is no specific law the school don't have to follow these guidelines. The business manager tells me that she is following the rules of the county council (school is an academy) so I'm going to see if I can contact anyone there to clarify their guidance.

I'm the meantime, how much does your school pay for KIT days and (if you're happy to say) which county are you in?

pink interestingly enough, I've had that conversation. I was part time and they did pay me an extra day - at 1/195. When I mentioned that, BM said I was paid at supply rate which takes into account lack of holiday etc for supply teachers and is, therefore, different to my actual daily rate, which they still maintain is 1/365. I think I'm just going to refuse to do the KIT days they've asked me to do if they're going to pay me £100 a day less than they should.

Ask them how they would pay you if you were part time and worked an extra day? If they would work it out at 1/195 then your kit day should be the same. If they say 1/365 then you can show them the teachers t&c's as it does stipulate it there. Unfortunately it doesn't seem to say anything about how to pay kit days (although I was looking on my phone this morning so could have missed it).

See this is what teachers I know in other schools tell me too. The last email I had back from BM basically said that they're following county guidelines and that includes guidelines on payrises so if they deviated from the guidelines for KIT days then they also wouldn't have to give us payrises Shock

I've found the County guidelines and they do indeed say 1/365 but they also say schools are free to pay a different rate (or nothing, which is surely illegal).

Think I might have to take it up with them instead.

Teachers pay is based on 1/195. I'm pretty sure that's in the book - it's how I was thought to work it out (we are a MAT) plus I know our payroll work it out like that and they pay LA schools, academy's, MAT abc council staff.
