My ex husband has finally agreed to start paying the full mortgage for the home myself and our 2 children are living in. I am currently on unpaid maternity leave and did an affordability check with the lender who agreed I can’t afford to pay. He refused to do an affordability check but agreed to start paying the mortgage
He hasn’t paid any child maintenance yet and isn’t due to be paying it until 1 Nov. He has now applied for a variation on the child maintenance.
I have attached what child maintenance have said about him not having a legal or equitable interest in the home. He in his own words in the application has said he will have an equitable interest in the property when it is sold
Logically I am telling myself his application will not be successful. Is this correct?
I need 3 months child maintenance payments until I can get my own mortgage so it’s in his best interests, in order to get his equity, to pay me so I can move to another property
