Used car nightmare, no V5

Posting here for traffic.
I viewed a car at the weekend, did a test drive and bought a full HPI check. All was good so I put down a £500 deposit. Collection was arranged for Wednesday. Balance had to be paid by bank transfer before collection so I paid the balance the night before and also arranged insurance to start the day after.

When I went to collect the car, having already paid in full, I was told that the V5 was missing. The dealer reassured me this wasn't an issue, some cars don't have a V5 and it would just arrive in the post in 2 weeks.

Before leaving with the car I asked the dealer if road tax had been paid. He said we couldn't tax it there and then because there was no V5. He said he would fill in a V62 and go to the post office immediately to tax it that way and then I could drive the car away.

I saw him leave with the V62 form and the cheque for the road tax which had been signed by his colleague in finance a minute earlier. I waited half an hour and then drove home.

Today he phoned to say that the road tax was higher than they expected and he asked me to pay an extra £120. They then proceed to say that the car hadn't been taxed at the post office yet because they were waiting for the rest of the car tax money.

I have been driving the car untaxed for 2 days and my insurance was probably void too!! I am absolutely appalled Shock

I phoned the DVLA this afternoon and they said that it will take 6 to 10 weeks to get the V5 and I cannot drive the car until then because you cannot tax a car without a V5. Is it true??? I've been looking online everywhere but found conflicting advice.

I used to work for the DVLA.
It will depend on what is on the vehicle record. If the vehicle has been correctly transferred to trade (meaning the previous keeper has been removed) a dealer can tax with a V62 and the £25 fee.
If the previous keeper lost the V5 and is still sat on the record there is nothing you can do - you can only apply for a V5 in your name and as the DVLA correctly told you can take up to 6 weeks. This is because they write to the keeper on record to confirm the vehicle has been sold. The previous keeper is given time to reply before they will continue to issue a new V5.

You can check the tax rate for your car online to work out the amount needed.

My last two cars didn't have V5s, both main/reputable dealer. In one case they'd lost it, in another they'd spotted an error and sent it back for correction - they'd owned the car from new so nothing dodgy about the car.

First dealer had arranged to tax it at a post office in the next town with the V62. He said I needed to be present carrying ID so that the tax was in my name not theirs, and in the next town because the local post office refused to do it on V62s. We ended up not needing to because the V5 arrived in the post to them the morning I was collecting.

Second salesman had told me I'd have to wait 5 or 6 weeks for the car as they couldn't tax it and therefore I couldn't drive away. I told him that it could be done as the other dealer could, he went off to ask his boss, and he was able to do it by calling the DVLA - he had a printed guide in his hand and I remember telling me that he had to press a particular number on the switchboard which had nothing to do with taxing cars - dealer enquiries or something random like that. I had to be present and read my driving licence number out to them on the phone.

So it can be done - push back hard at them to get this sorted asap, and assume that you'll need to be present when they do it.

Ps just to add you can’t personally tax it without the v5 just to be clear but the dealer deffo can with the v62. I’d be checking the cost of the tax to make sure they aren’t lying about the price and make sure they pay for the new v5 and not yourself !

the Dealer 100% can tax at a post office with the v62 so the car doesn’t need to be parked up , they also need to apply for a replacement v5 which will take a few weeks to come to you

I dont know the answer but why would you doubt what DVLA have told you. I assume youve purchased your car from an independent garage and not a main dealer? , if it were me i'd be going straight back to the garage.
Is it also not a so3dgy situation that they have acquired the car without a V5 in the first place.

We recently bought a car without v5 and yes, had to park it up. Previous owner knocked off the 25 quid for a new v5 as he didn't realise it was missing til we viewed and collected. He actually left the tax running but we didn't want to risk it so didn't drive it.

Their issue with the v5 so they should suck up any extra costs imo
