second hand xbox 360, how can I tell if it can go live?

As the title says really. I bought my younger son a xbox 360 250gb with wifi built in. It's exactly the same model as my older sons. I can't figure out how to tell if live will work, has it been banned, how do I set up the account. It took bloody ages to set up the new one as the controls are not second nature to me and it was mega frustrating. I don't want to promise ds2 live for xmas if it can't be set up. Any clues? If you want your other son to have his own xbox live account then you will probably have to pay for it separately to the other account for your older son.
