Named school changed in statement, need help

Well I lost the Transport Appeal,they said that L going to that school, was a case of 'parental preference' Forgetting the fact that it was the LEA that told me to move her to that school 2 years ago when we had to move and transport was refused then as well.

Feeling so beep about this. The LEA said in the meeting with the panel that they were planning an urgent review of L's statement to get the named school change. To her designated school, a school that is terrible, ofsted reports were terrible, and even talking tooter people they have said no to send her there.

L has autism and a servere speech disorder, with a statement and attends m/s school

So I have no idea what to do, I am stick of having to fight all of the time. I said who well L is doing at her school, that she trusts them, how they understand much more of her speech then before, even her friends support her. She has had the same LSA for 2 years and they trust each other so much.

Forgetting that they refused transport, how can the LEA drop into the panel meeting in front of 4 councilors that they were arranging a review to have the named school on her statement changed to the crap school? This was the first I had heard of it.

L is doing so well, and they want to just yank her out of a great school into a new school.

I know that I have lost the transport battle, but can I complain to local gov ombudsman that the LEA lady said that L's statement was going to be changed. Knowing that it cant just be changed just like that????

Sorry to hear the LA are being so difficult. If you have lost the transport battle and your DDs school is 'your preference' then they can't change the school without your agreement. They can refuse to keep her at her current school only if it isn't financially viable, (or adversely affects the education of others or cannot meet your DD's needs etc but that doesn't sound like the case) but the only extra expense of having her at her current school would be the transport costs. So if you are paying transport costs there is no reason to move her.

I think they are basically threatening you with this review to move to your 'local' school if you keep on insisting that you want transport paid. You may have to pick your battles here. If you can possibly afford the transport, staying at the current school sounds like it's the best option.

My DS (Statement, ASD) is in a school 4 miles away, when there is what the LA call an equally suitable (crap) school that could meet his needs, 1 mile away. I was allowed to name the more distant school on his statement only if I signed a form agreeing that I would pay all transport costs, so I know where you are coming from.
