I haven't personally had one of these calls but I've heard people complaining about this on other sites. It seems to be their way of deciding whether to award higher-rate or middle-rate DLA.

I've heard this from others too. And it doesn't surprise me one little bit . Someone I know recently had a letter refusing DLA just one week after application - just how much consideration had it been given?? - then following a letter asking them to reconsider they've been awarded high rate care. They seem to be on another planet!

I think you can appeal if you've been awarded the wrong rate. Ds1's sleeping pattern isn't too awful now so we didn't bother with this. In your situation I would stick to your guns.

Not surprised you feel angry. I always feared this type of phone call when I was applying for DLA, I even took a photocopy of my DLA form and placed it next to the phone, just so my partner backed up what I had said.

You can appeal but they alays warn you that you risk losing the award you have.

You don't have to justify yourself socci. You absolutely 100% deserve high rate by what you are saying. Remember it's your entitlement

macwoozy Fri 18-Feb-05 18:36:39

My ds is up every night which I stated on the DLA form, and I was awarded zilch. Then I wrote a 4 page letter explaining all his problems and I was awarded higher rate. Wheres the logic???

ImuststopdrinkingBlossomhill Fri 18-Feb-05 18:38:26

All depends on which pen pusher's desk it lands on and whether or not you have ticked the right boxes.
So as isn't there enough to deal with without having to prove you deserve it???

misdee Fri 18-Feb-05 18:40:54

my dh gets low rate care. we are in te processing of reapplying for him as he is totally dependant on others now. makes me the way the DWP treat people.

ImuststopdrinkingBlossomhill Fri 18-Feb-05 18:47:20

Misdee - what planet are these people on??? It just makes me sick that the people assessing each case don't have a bl**dy clue

misdee Fri 18-Feb-05 18:48:29

we're hoping that the fact he is now being assessed for transplant and is under one of the uk TOP CARDIOLOGIST WILL HAVE SOME SWAY.

misdee Fri 18-Feb-05 18:49:03

oops caps.

btw dh was turned down 2 times before it was awarded.

ImuststopdrinkingBlossomhill Fri 18-Feb-05 18:50:49

If it doesn't misdee then i am well, speechless

misdee Fri 18-Feb-05 18:53:05

BH, it honestly wouldnt surprise if they turn him down for middle/high rate care. the people who assess the forms have no idea about DCM and its effects. am just hoping he gets to keep his mobility as without a car he is housebound.
