Am really confused and looking for some help.

I wonder if anyone can help me. Ds 4 starts school septemeber. We have a rough road though nursery. He's always been delayed in his trackers. He's currently on the 22-36 months in all areas. He's on wave 3 sen support. He has always had Additonal inclusion support and funding. He makes progress but not expected progress. He's sen plan for school basicly needs support for everything. Now and next board, visual timetable and aids, time to progress, well planned changes and transtiton, help with nappy changing, help to say on task, help with forcus, help to make friends and interact, he needs comfort and support and also has no sense of stranger danger and makes friends with adults the moment he meets them.
We put in for a EHCP last octorber got refused we appealed they sent a EP in to assess him. She did a 45 minute bas 3 cognitive test and said he's not delayed at all in any area and that he is average. She said that he has none of the issues said in the above. She said nursey had all is tracking and monitoring wrong. The judge found it all confusing so only took the ep5 evidence on board and decided no assessment needed. We decided after this maybe try changing nursery so we did he started the beginning of February and we are getting told exactly the same as the other nursery and that the specilalist teacher is support the nursery with the issues.
Also don't understand that of the EP thought everything was fine why do they continue to give him additional inclusion support and funding. It makes no sense.

Sorry to hear this is difficult. I found it very difficult to deal with professionals and their reports too. Does your child have a diagnosis? From what I have seen, some EPs will sit on the fence, or make unhelpful comments, if there is no diagnosis. If there is a diagnosis I have seen standard solutions being proposed rather than individualised suggestions. Based on your post I suggest:

  1. If you do not have a diagnosis, I suggest that you perhaps make this your first port of call. We took a long time to accept a "label" but without this it is incredibly difficult to get much further in the system. Speak to your nursery, SENCO, GP, Paediatrician etc to see how to get this moving or clarified.
  2. Call the SENCO at your new school and ask to go in this week (before end of term) to discuss support and transition. Get a list of all the things the nursery does and take it with you. Hopefully they can do a lot to help without an EHCP in place.
  3. I think you can re-apply for an EHC Assessment 6 months after a refuse to assess decision. By then you should be into school so will also have the view of the SENCO which will hopefully be supportive. Spend the time building your case and gathering evidence. Ask the professionals on your child's case to write letters saying "they support assessment for an ECHP" and your child "May benefit from a plan". Your application and appeal probably failed because of lack of evidence so make sure you have lots of it next time.

The only thing we don't have is diagnosis which he was put on a 2 year waiting list in January for panel for Autism.

We provided 18 months of evidence from SALT, inclusion support teacher, targeted learning plans, tracking, nursery observations, pediatrician report and health visitor report. All supported him needing support. Targeted learning plans all showed he was making a little progress but not meeting targets so so the inclusion teacher reports.
The la refused to assess on the account he was making a little progress. His targets are learning 10 names he managed 1. Improving on fine motor skills. Said he's at least accessing more fine motor skill activities. Reduce anxiety about being in nursery/School. He's not as upset as he was.

The peastrcian, SALT, HV all wrote he may benefit from a plan and that he will need support in school. It was only the EP who said he wouldn't it really made no sense.
We got refusal to assess in December took it to appeal. Got told they were applying again to EP panel ( was denied originally as they wouldn't see him unless he was making no progress at all) on the 6th of kanuary on the 10th it had been approved on the 18th we were told the EP was coming in that afternoon that she wanted us at nursery at 3. All tribunal evidence had to be in on the 2nd February. We were informed on the 3rd Feb that EP had been sent to tribunal and we finally saw it 10 days later. It was all very odd.

Also we have had 4 transition sessions at school already. They said this week they will send down all the policies, procedures and plans they have already got ready to put in place. We have also had 2 transition meetings and I can't get over how worried they actually look even though they don't say it.
