dds EHCP declined!!

im so upset. my dds ehcp has been declined, she has autism. has anyone elses been declined?!

What stage of the process was this at?

We had our initial request for an assessment turned down but got the decision overturned.

Have you looked at the IPSEA refusal to asses pack or IPSEA in general has very good advice on appeals during the EHCP process. www.ipsea.org.uk

she had the assessment but ehcp was rejected. everyone said she would get it including the senco. just feeling really deflated now, she has 1:1 and low receptive communication and was needing to be picked up at 2pm last school term as the school was finding her difficult. i will check out the link thanks.

You should definitely appeal.

IPSEA have a phone line too. It can be quite hard to book in a telephone appointment but it's worth it as they are very helpful.

You can also try phoning SOS SEN or going to see them at the Autism Show. Also their booklet on appeals is really useful - information on this page: sossen.org.uk/news.php

If you are saying that school asked you to pick DD up at 2pm because they were finding her difficult, they should not have been doing this as it is illegal exclusion.

Clearly they are not able to meet her needs and this should form part of the grounds for your appeal.

A lot of LAs refuse to issue EHCPs in the first instance and then cave in when you appeal.

i had to pick her up at 2pm for a whole term. it was a nightmare as i have a baby and had another child at the school and i had to hang around outside the school waiting for 3.30 to pick up my other child.

That is appalling Butterfly and should not have happened. If they start that nonsense again ask them if it is an official exclusion authorised by the HT. They will soon back off.

If they try that again, tell them that you will not be picking her up unless it is an official exclusion, which means that they will have to send you a letter every time explaining why and giving you notice of your rights in terms of governors' reviews and the like. And exercise those rights - if the governors have to get involved every time they are likely to ask questions about why the school keeps excluding the same child. I suspect you will find that they become desperate to support you in your request for an EHCP.
