Another Statement to EHCP question!

Hi all, I am wondering if someone could help.

I have received the Draft EHCP. There are numerous amendments to be made, which the Case worker is starting on, and doesn't appear to be contesting.

However, do I name a School now, or do I have to wait for a final version of the draft plan?

I'm thinking if I name it now, then they can start the consultation with that school or I may have it completely wrong

What stage are you in the process? Were you give notice of transfer, how long ago, has a transfer review meeting happened?

In any event, if you know what school you want now it can only be helpful to let the LA know.

We've been in the process for months and are well over all deadlines. I am getting 'support' from IASS who just seem to agree with the LA all the time. Oh and no, we didn't get any notice. It was thrust upon us at an AR meeting.

I will name the school straight away.

Can they still be working on the changes needed during this time?

Oh, lovely, a totally unlawful process then. Did they by any chance do a new assessment, or ask whether you agreed to use other evidence instead?

I don't understand the process to be completely honest, but I'm guessing it's not lawful at all.

No new assessments and they never asked me anything. In fact, an EP, who has never met DD stated everyone agreed that a 4 year old report was relevant which never happened at all and she was talking shit

To be lawful, they should have given you two weeks' notice to start with. The law requires that they carry out a full assessment on transferring from a statement to an EHCP unless the parent agrees to other reports being used, and unless the experts who wrote the reports also agreed that they are sufficient. You might like to talk to SOS SEN or IPSEA about this.

I should imagine the process is as shit unlawful as the actual draft EHCP.

That will certainly be on my to-do list for Monday.
