Well as you know I have had the unit named as ds's post 16 placement which I will be appealing of course but intend to go through all the attempts at resolution although I have no intention of budging my position.

So the letter from the LEA invites me to contact the LIO (Inclusion officer) to discuss any concerns.

School also want to speak to LIO as well as he stated that the unit couldn't be considered a placement for post 16 as it was unsuitable.

So the Head of the unit has been phoning for a meeting but hasn't managed to catch him so I offered to phone(using his direct number purloined from ds who works there grin )

I have to say he is a nice bloke generally but I'm feeling pissed off so wasn't at my most pleasant but asked for a meeting to discuss ds's amended statement.

Anyway it's not on the system, he had no idea it had been amended and his input was declined by the LEA (probably because he said the unit wasn't suitable) once the solicitor got involved (although he wasn't aware of the reason why only told that someone else would be dealing with it).

So spoke to the head of the unit who also hasn't had any communication from the LEA so forwarded him mine and he has taken it to the Head of school who is contacting his legal department because the LEA have named the unit when it isn't a post 16 placement and he isn't happy either.

So no idea what is happening, solicitor has been very quiet although I assume she is working behind the scenes but it looks like the LEA will be feeling a lot of heat with two legal teams now challenging the decision.

Anyway have a meeting at the unit tomorrow with LIO to discuss my concerns and school's concerns BUT can I just check as I am sure the LIO will want to talk of more unsuitable alternatives, now the unit has been named my appeal only needs to be about why the unit is unsuitable doesn't it not any of the other possibles that the LEA chose not to name?

Sorry, no help asdx2. But it's a strange old game the LA is playing. They tell you to contact the LIO, their officer, who they have also taken off the case? Do you think it was a standard letter they sent you, not specifically relevant to your case? Weird.

God knows tbh, the named officer is useless and so you get no sense from her not helped by the fact she hasn't got a good grasp of English.
The letter mentions the school I wanted as them not choosing to name it so it's definitely my letter. The LIO is the LIO I should have but wasn't in on the decision and they invite me to contact them if I have concerns and advising me of the opportunity to appeal so think it's mine anyway.
I think the place is run by loons tbh.

Technically the appeal is against the unit, but they can offer another placement and just send you another amended statement at any time - we had a statement amended after we had started an appeal and then had to change to appeal to being against both statements.

So in reality you might have to argue against anything the LA might put on the table even at the last minute.

It gets worse to be quite honest angry

The letter I got telling me they intended to name the unit is just that. They haven't amended the statement yet and the LIO whose responsibility it is who I spoke to today hasn't even had communication telling him that that is what has been decided.

Really fed up of it all tbh. sad Apparently the LIO recommended the placement I requested back in February and then has subsequently been cut out of the process although I am advised to contact him by the LEA.

His input wasn't asked for at the Panel that decided to name the unit and he is unsure how he can amend a statement to name the unit anyway seeing as it isn't a post 16 placement.

The meeting today just confirmed what had already been said that Jack needs the placement I have asked for and that the LIO recommended.

He is very much aware that I am going to appeal and he knows that only a statement naming the provision I want will stop that process.

He hadn't been privvy to the Psychiatrists report, the ed psych's recommendations, the assessment by the Independent school or the unit's response as to whether they could cater for ds. Well he is nowgrin

So he's back off to the powers that be to tell them that there will be no compromise but they can contact me should they decide to see sense and I will halt proceedings.

Let slip that with the amount of administrative error the Judicial Review is likely to happen after Tribunal and that we were considering making a case for educational negligence just to concentrate their minds a little and to make the prospect of the Ind SS fees seem cheap by comparison grin

So basically it's a shambles but playing neatly into the solicitor's hands as I think that pretty soon they will have had enough rope to hang themselves.

Well, let's hope they are just playing into your hands with their astounding incompetence. I just don't know how else to respond, it just seems amazing. So tempting to Daily Mail it! grin But it's probably only those in our world who would appreciate it.

Don't think the Daily Mail would believe the incompetence, mind you we are Labour controlled so would probably go for it anyway especially if I let slip the named person and so the point of communication doesn't speak fluent English and has a terrible grasp of grammargrin

it just seems to have got daft on their part asdx2, no one would believe it in the nt world! They're definitely being very selective as to who they listen too, I hope your solicitor can get some quick results for you. Did you know you've posted your ds' name in your pp?

smile it's one of my favourite names but we already had a couple in the family when I had my boys. One of them has a brother called Daniel hmm grin

Oh forgot to say Inclusion Officer apologised today and said I wasn't to feel I had been singled out for such shocking service it is widespread in our LEA presently.Apparently that is to make me feel better angry
