Can I be really self centred and be worried as am just about to ask for DS to be assessed for statementing? Worried there wont be any legal provision any more and even if there is, the system will be in an even more like quagmireish mess so even harder to get anything through.

It seems to me on a very quick reading, that Statements will be abolished and replaced with Education, Health and Care Plans. However, it doesn't seem clear to me that the Care Plans will be statutory in any respect, which would mean that no funding could easily lead to no services without recourse to anything. If you've found anything that suggests I've misunderstood that, please post.

Hey everybody, stop worrying. The plan is that the new assessments will be statutory and will have the same legal status as statements, you will still be able to appeal to tribunal although it will be mandatory to take part in mediation first. This could be a good thing as hopefully more parents will be able to avoid lining the pockets of lawyers. The remit of the tribunal will no doubt need to be widened to take into account health and social care provision.
Nobody knows what the new assessment will look like, I suspect it will end up looking much like a statement, the difference will be that health and social care provision will also become a legal entitlement which can't be a bad thing. It will still need to have a way of naming a school in order to be of much use. There is no talk of scrapping the code of practice, just revising it and doing away with School Action and School Action Plus.
This green paper has lots of grand plans but very little substance on how to implement any of them. Finding ways to implement all this will take ages; due to the current financial climate many organisations will think twice before taking anything on.
