Marriage has broken down. Implications if I leave?

My marriage has broken down. My husband won't leave the family home/kids so we have been stuck like this for some time. I think he's in denial and has said if I want the marriage to end it will have to be me to do it by leaving. We have 2 kids.

I could scrape together enough to rent a 2 bed home. My kids wouldn't want to leave their family home to live in a not very nice small home where they share a room. 50% custody would be what we would both go for.

I just do not know what to do. I cannot handle this limbo situation any longer, seriously can't handle it. It's soul destroying and I'm miserable. I just don't know how to stop my kids being completely destroyed by this experience. They are going to think I'm leaving them when that is not the case at all!

I didn't want to just read and run. I was up until a few weeks ago, in a similar position. I got up and walked out with my daughter and stayed with my sister. My husband is now living with his parents. Our situation is that we cannot either of us afford a house plus a rental, so we are going to sell up and rent separately. However I believe that if you are the main carer for your children, you could be entitled to the house. I'm certain someone more knowledgeable than me will come along, but I think the most important thing is to seek the services of a good family solicitor.

Have you had legal advice?

Unless you're in fear/there's violence or abuse, I wouldn't leave the house, and definitely not the kids. You may end up the non-resident parent looking for access. If you need to sell up, he'll be able to drag it out if he's awkward about viewings etc.

Get legal advice, get your divorce underway.

Move into another bedroom or turn another room into a temporary one, live as separately as possible.

See what a solicitor advises and at least you'll be able to see your way to an end of it.
