Will we get our deposit back?

We are due to move out of this house in a few weeks (landlord wants his house back .

It's his house and it was newly done when we moved in and it is not 'newly done'now.

What can he take off our deposit and what can be classed as general wear and tear. For example, the carpets are dirty but no permanent stains. There are some scuff marks on the paint work and a few chips at the end of the laminate work surface.

I would add that all the materials are really cheap and the workmanship is shoddy so we haven't destroyed anything that was built to last!

Your landlord is entitled to write the cost of "fair wear and year" off against his taxes, so there's no need to take anything off your deposit for that. The damage you describe sounds like it's just w&t, unless the place was fully furnished and you're planning to nick it all.

Did you move in after April 2007?

as a landlord i would classify this as wear and tear - but it very much depends on how long you have been in the flat. if you clean it thoroughly and have the carpets cleaned professionally i cant see he would have much to complain about.
