Are problems with soakaways usually covered by buildings insurance?

We have found out that the main soakaway at the front of the house has failed and we need to replace it. The recent heavy rain has meant that water leaked into our basement which has ruined the plaster and the carpet.
Does anyone have any experience of this, was it covered by insurance?
(We will need to dig up our drive to put in a new soakaway so lots of hassle/expense)...

DH (who is an insurance claims professional) says it won't be covered. If you have accidental damage cover the damage in the basement might be covered, but would be unusual in his experience
