handing in your notice early, do u still get deposit back?

my estate agents r crap takes them ages to fix things i even fell through my bathroom floor (im not fat i promise lol) and it took them over a week to fix the floor well make it secure and its maybe 4 weeks later and ive still no tiles on bathroom floor and i have a 4 year old in my house, im off on a rant all ready
anyways my lease isnt up till early december can i hand in my notice early and still get my deposit back or does it depend on estate agents

If the lease doesn't run out until early December then they will keep your deposit money to cover lost rent (and possibly sue you for any extra amount too). If the floor is the only issue, then nag them until it is fixed; if it is lots of things, call your local authority and get someone around from the private accommodation inspection team to do a report and speak to the LL or EA on your behalf. If the report is damning enough and they refuse to take action, then you might be able to move and claim back your deposit through the TDS dispute scheme.

Unless the property has become unfit for habitation (and I don't know if your collapsing floor would count), then the normal notice to quit period would apply, and they can deduct a sum from your deposit for rent in lieu of notice.

You might be best off seeking specialist advice in light of your specific difficulties.

as people say its not the deposit its you have a contract until december
CAB might be an opition as well - but keep records of every contact - and take photos
