PTA and Charity Status

Hi, we are in the process of registering our PTA as a charity and we have just been informed that one of our committee members has a CCJ (or has had one in the past, he did not disclose all the details). Will this effect their eligibility on becoming a trustee.

A CCJ does not bar someone from becoming a charity trustee. The things that do bar you are:

- having an unspent conviction for an offence involving dishonesty or deception
- being bankrupt (or subject to bankruptcy restrictions or an interim order)
- having an individual voluntary arrangement (IVA) to pay off debts
- being disqualified from being a company director
- having previously been removed as a trustee by the Charities Commission or the High Court due to misconduct or mismanagement

Also if the charity works with children or vulnerable people an individual may be disqualified or barred under the Safeguarding Vulnerable Groups Act 2006.
