Can you confirm if this is a reception class entry, and if the usually admissions number is a multiple of 30? (of 15 if there is mixed year teaching anywhere in KS1)

If so, then the appeal would be held under Infant Class Size (ICS) rules. This means that appeals can only win if a) a mistake has been made in handling the application and that mistake cost your child a place, b) the criteria are themselves against the Admissions Code or c) the decision is just so perverse it cannot be allowed to stand (eg child protection issues).

First thing, you need to check the reasons why they made no offer. Did they place your DC in the correct category (is there are formal catchment area, and are there separate categories for in-catchment and out-of-catchment siblings)? Do they have distance from home to school correct?

the class size is 30 but was exceeded to 35 ...4 yrs ago

The class size can go over 30 if the additional children count as 'excepted' (eg second of twins, late applicant with an EHC plan, successful appeal).

That sets no kind of precedent for allowing larger classes when ICS rules apply, because they cannot admit over 30 other than formally excepted children.

Have you received a letter explaining why you did not receive an offer? If not, first thing to do is chase it on Monday.

I think you need to find out what the last place was awarded on ( sibling/ distance) and see if you would have been higher up the criteria. Unless they have made a mistake in the allocation I am not sure you would win an appeal.

I think you can ask the local authority what the last place was, they should be able to tell you distance and criteria ( it was included in our letter as part of a list of over subscribed schools)

So if you are in catchment and were criteria 3 and they awarded to criteria 6 you would have a case. If they awarded to criteria 3 and you were closer than the distance you would also have a case, if not then you probably need to sit it out

It does seem daft. Hopefully spaces will clear and you will get them all at the same school

You are best to accept the place and stay on the waiting list for your preferred school and hope a place comes up soon
Can his mum not take him to school while you do the other school run?

Who looks after the other two children while you take four to school with a new-born in a pushchair? Could that person look after the new-born while you do the school drop-off?

Keep your existing place in the meantime and keep on the waiting list. Seems ridiculous but I believe that is the best way for now.

If it's class size 30, it is an infant class size appeal and these have special rules. In a nutshell, unless a mistake had been made you can't win an ICS appeal.

Sadly, even if you had 12 children, your difficulties in arrangements for transporting them isn't a grounds for appeal.
