REFUNDS what are my rights

Just a quickie really.I bought ds a pair of expensive skate shoes today from a small independent shop and he doesn't like them!There are v few shoes in this shop to fit him as he is only size 2 so I took a chance as it is his birthday saturday.Can I get a refund? I paid £49 for them on my visa I have a feeling I can't they are closed now so can't ring them will have to go tomorrow am What do you think I feel I've just wasted all his birthday money!HELP

if they havent been worn then yes you shuld be able to but its at the shops discretion. take him with you to see if there is anything he likes, as the store may be more likely to exchange.

Unless there is something wrong with them, then it is down to the goodwill of the shop. They have no obligation to exchange/refund something just because you made the wrong choice for a birthday present.

Don't think you have any rights as such if there is nothing wrong with the shoes, but I'd call the shop and explain the situation. If you're very lucky, they might refund you, but it's more likely that they will give you a credit note to use another time.

Only out of their goodwill I'm afraid. No legal obligation on their part if you just change your mind, unless you had specifically agreed it verbally at the time you purchased. Sorry, but worth a try.

no he looked in the box and said yuck!Cheeky bugger I wiuldn't spend that on me atm but thats another story.I bought them today at 12 and he saw them at 4 didn't even try them on
