Hello, first time posting.
I have decided to book a week long girls holiday and have asked my little boys dad to take him while I’m away. He has said he will only take him if I give him back some of the child maintenance he would be paying if he is going to look after him extra nights. Is this legal and will I have to pay him for doing a couple of extra nights?
He usually has him once a week and my mum is willing to do a couple of nights for me too. So he will maybe have him 3-4 nights.

Will he pay you extra for the week/s when he doesn't have him for the night because he's chosen to go on holiday?

He has booked a long weekend away but said he will take him an extra day to make up for it, this is his logic 🤔

Child maintenance is calculated on salary and the number of over nights with the NRP. Do you have a family based agreement or does it go through the CMS or is it court ordered. Either way, the rate your EX pays should be based on his salary and how many nights he has the kids. So this should already be taken into account - he’s trying it on.

Thanks NothernSpirit he used the calculator to figure out his payments and we just arranged it ourselves. I thought he was trying it on too just want to see if what he is doing is legal or wrong. Constant drama when I want to get a night out or break, so sick of it :(

Yes that’s right. Tired of the money threats and wouldn’t care throwing him a tenner it’s the fact he wants to argue over £10!
