Birth fathers approval needed - help?

Hiya,
Not sure if right place to post but to be honest have no idea where to post.
My DS has a small chance of being featured in a documentary coming up but they have now informed me that mine and my partners (DS's 'papa') permission is not enough they need his biological fathers too.
His dad has been NC for 3 years (DS is 4) now and is currently serving time in prison. He's a very nasty man and I'm pretty sure he wouldn't give permission - he's pulled a similar stunt before.
Does him being in prison kinda mean he doesn't have a right to say no?
We are about to start legal action to change name, etc but this won't happen before the permission is needed by.

I'm not sure that's wise, surely that could cause some serious legal issues if caught.

Does it have to be him? Can you just say you've lost contact and he isn't interested?

Astro that's what I was hoping but the person I spoke too seemed pretty sure that his was also needed as he's named on BC.
Fingers crossed though, I have absolutely no idea what prison he is in (I don't want to know either) and would probably end up pulling DS out of it rather than make contact Confused

Go back and tell then he is an absentee father, that you have no idea of his whereabouts (which is true), nor how to contact him.

Is there any chance of him seeing the documentary and it putting you at risk? Would you be safe?

It is normal to need permission from all those with pr though, yes.

Changing name won't remove his PR. There's no law about needing consent from both parents to appear on TV as far as I know so it sounds like the TV company's rule rather than it being about rights.

AliceTown we are aware of that we aim to one day have PR revoked but for the moment name change so he doesn't feel left out from me, DP and brother is the way to go.

It wouldn't put us in danger I don't think but it is something we are aware of.
