Does anyone know the facts on this:
Ex and i have 2 DCs - he pays x amount monthly private arrangement, no one else involved.
Roll on a few years he and his new partner had a DC - they have now split up.

She is claiming a large amount from EX - ignoring the fact he has 2 other DCs.
She is going for 20% of his income and says it is all hers. I argue it is 20% split 3 ways and as he actually has my DCs less than hers ( puts into a lower ON bracket) it is actually more like 75% to 25% - however, i will go split three ways for the sake of peace.

She is now going through the CSA and is alleging that they will ignore his other 2DCS in the calculation because we have not gone through the CSA - is this true.

I will be so pissed off that I might have to go through the CSA just so she does not screw the EX and hence my DCs over. We have a private arrangement, it works - took a while but i do not want to upset the calm applecart we have.

Anyone know if this is true.

Think she's wrong. Let your arrangements continue and he will argue it out with her I believe via cms.

I think she's wrong as well, he can presumably prove the payments to you?

She's wrong.

Let her go through the CSA - and disenage, let her find out in her own way.

The CSA aren't interested in what agreement two consenting adults have - they care how many children are involved.

My ex has a private arrangement with regards to another DC he has and I know it has no effect on the amount of maintenance I receive as the CSA do not take it into account. It is possible that it is because he doesn't declare it but knowing him I doubt it, believe me he resents every penny he pays.

WTF - so he has two DCs and the CMS calculate your payment as if he had one - this is what I am worried about and if they do do this to you - why?

It's up to your ex to contact CMS and tell them that he has 3 kids so they give her the correct amount. They can only go on the information that they have. Without the names and date of birth of his other 2 kids, they wouldn't know if he was trying to get out of paying. For 3 kids, I believe that the % of his wage that he has to pay will increase.

Just contact cms yourself. . It's either grief off her or grief off him. .
Least you will know where you stand and she will have her bitchy face shoved out of joint.
