Photographer - wondering if I have any rights?

OK...

I went to a photographer (the one who has an concession in Mothercare Watford store) back in August with my two kids.

I made it very clear that I didn't want to spend ££££. I had a voucher for a free session and 1 7x5 and I paid £70 for 2 A4 pictures.

THe photoshoot went OK... (apart from being confronted by the woman on reception who took offence to the fact I had two kids in two years) but when it came to the purchase, I was ushered into a small cubicle (with my two small kids) with a different person who put a major pressure on me to pay more money (at one point telling me that he would take me to a bank to get money - all without allowing me to leave... He only allowed me to leave when my elder child decided it was time to trash his computer (16 mo) and my younger child deicded to projectile vomit (2 mo))...

Anyway, i stuck to my guns and took the 3 photos I was expecting - except 10 weeks later on, I still don't have any photos and keep getting the run around about where they are.

I do strongly believe that this is because I didn't spend more. I think they are p*ssed off with me and so I'm not going to get the photos.

So, what recourse do I have? I'm not intending to let it slip with the photographers, but I don't think they have any interest in ever giving me the photos (even though I actually paid £80 for the two A4 photos)

I would suggest a strongly worded letter telling them that you want your photo's and giving them a deadline at which point you will be taking them to the small claims court.

Would also suggest Consumer Direct who will tell you exactly what to do and probably e-mail you a template letter.

Your local trading standards should also be able to help you.

It would also be worth taking this up with Mothercare's head office. Talk to their Head of Communications and say you are thinking of going to BBC Watchdog.

Please let me know how you get on. Usually taking something straight to the top gets some arses kicked.

Make sure that everytime you speak to someone you make a record of their name and agree a time by which they will get back to you.

Most helpful... I've had a reply from the head of whoever deals with the concessions (because my issue isn't with mothercare with with the concession)

And, I don't much care if they can sort the problem, but I really DO want them to know about the shoddy service I've had from start to finish.........

Given that it was 5:45 on a Friday, then I guess I'm pretty happy I got a call back.

Clarice - How did you know his number? I'm very grateful!

We'll see what we see in the next week (still not sure I'll ever get any photos!) but feel better for having complained about the shoddy service (not from mothercare, but the concession!)

Hold out for your photos!

And if it goes really well you might get a goody bag/vouchers from Mothercare.

Mothercare will care that a concession in their shop is giving shoddy service. It's not a massive leap to "Mothercare is shoddy".

They absolutely love these calls at 4.45pm on a Friday

Just keep a record of who you talk to and when and so if it all goes tits up you can head off to BBC Watchdog or similar - lovely story - cute children, well known children's store, pressure selling...

Well, thesaga continues!!

Photographers called on Saturday and again yesterday swearing blind the photos would be sent recorded delivery and be here by 1pm today.

Mothercare called today to confirm the same...

So, I'm hopeful but err.... No photos!!! GAH!!

Mothercare said they would call back tomorrow to ensure I'd got them, so haven't bothered contacting them today...

It's a joke... but rather less funny!!!

Will keep you posted!!
