Hi smile I am looking for some help if possible.

I share care of a one year old girl with my ex partner the father - we have been court recently and had an order in place stating the days of each have we have our daughter and this has been followed. except - I took my daughter away for the day last Saturday and the car broke down at a fun park, we had the AA out and as it was then late by the time they came and left, the car had a space saver tyre put on until a permanent one the next day, we stayed in a BnB and travelled home the next morning at 8am. She had been due back to the Dad at 5pm on the Saturday but as we broke down and she was due dinner and bed (the journey was 2 hours home) it was in her best interest to stay the night and return her in the morning which I did by 930am. Now I kept the dad informed the whole time, he wasn't happy in the least but was OK and thought safety was paramount! He wanted proof of the AA which I showed him etc and that was what I thought the end of that.

**NOW.... my daughter and I are due to go on holiday Tuesday morning (south coust england) and this has all been approved month in advance with the Dad on email and I am meant to be picking her up Tuesday morning and coming back Sunday. The father has now said I can not take her to the grandparents house and that he will take the night back we broke down and I can have her Thursday night. This breaches the court order ruins my holiday and I have the week booked off work. I am very upset as I have no plans all week and we were very excited to see the family who have retired to the coast. What can I do? he has no job and I am worried about her wellbeing also, I had to take her to the doctors last week as an emergency appointment as when he handed her over he was sick I recognised this and it ended up being croup, which has been treated. I contacted the courts ages ago as he previously did not approve the holiday (he did in retrospect on email) and they are very busy and have not come back to me as yet. So basically he wont let me pick her up to go away and is not giving her back on wed as he is meant to, what rights do I have. IMPORTANT : HE HAS SAID IF I PAY HIM £200 I CAN TAKE HER, IS THIS EXTORTION? Please can someone advise me what to do, I have spent £1000s with solicitors and can not afford to spend anymore. I have called the police about the money and they will contact me within 24 hours but they were powerless last time something similar happened saying it was a civil matter, Help please.

Who has her now? I'd just go with her. Don't take her to your ex in the meantime. What a git he's being.

I agree, if she is with you now just go tomorrow to your parents. I assume he said all this via email so you have proof he intended to breach the court order?
